TERMS & CONDITIONS

Hiking, trekking and adventures are risky by nature. Rest assured that Hitchhikers Guide Adventure Company will take every precaution to ensure the safety and enjoyment of guests; however, accidents can happen. HG Adventure Co excursions take place in remote locations, so access to medical care can be limited. In addition, Mother Nature can be unpredictable and may disrupt travel plans with hazardous weather and/or trail conditions. HG Adventure Co’s terms and conditions are based on time-tested industry standards. The following Terms and Conditions limit HG Adventure Co’s liability and defines the rights and obligations of guests:

DEPOSITS & PAYMENTS

All reservations must be paid in full at the time of booking. All bookings must be paid in U.S. dollars. If you require special arrangements, please contact HG Adventure Co directly to work out a payment plan. Any special payment arrangements must be approved by HG Adventure Co in advance. HG Adventure Co accepts debit and credit cards, including Visa, Mastercard, Discover, AMEX, Diners, CUP, JCB and Maestro in addition to payments via Apple Pay and Google Pay. If you wish to cancel your trip, you must notify HG Adventure Co directly in writing.

ITINERARY CHANGES & ALTERNATE TRIPS

HG Adventure Co makes arrangements for these trips many months in advance. As a result, HG Adventure Co must reserve the right to make alterations to the trip, both before and after booking (and in some cases, while actually on the trip). Most of these changes will be minor, and, in all cases, you will be advised at the earliest opportunity.

If a significant change occurs, you will have the choice of either accepting the change, purchasing another trip from HG Adventure Co (if this involves a difference in price, you are responsible to pay any increase, and HG Adventure Co will refund any decrease), or canceling your trip and receiving a full refund.

 

Sometimes changes to the trip may be caused by forces completely beyond HG Adventure Co’s control. HG Adventure Co does not accept responsibility for delays or cancellations caused by war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, technical problems with transport, closure or congestion of airports or ports, adverse weather conditions, acts of God, and similar events beyond HG Adventure Co’s control.

HG Adventure Co reserves the right to cancel trips under any circumstances. However, in no cases will HG Adventure Co cancel a trip less than 7-days prior to departure except for reasons outside the company’s control, including, but not limited to, reasons such as those described in the Terms & Conditions, your failure to pay all amounts due as detailed in these Terms and Conditions, or any other failure by you to comply with these Terms and Conditions. HG Adventure Co further reserves the right to cancel any trip within 7-days of the departure date if an insufficient number of people have booked your chosen trip, or if cancellations by other participants cannot be re-booked, thereby causing an insufficient number of people on the trip. If HG Adventure Co is forced to cancel a trip due to insufficient numbers, except in the case of failure to pay all amounts owed, you may choose to accept a full refund, or transfer your reservation to another trip offered by HG Adventure Co. In the event you choose to participate in another trip, you will be required to pay any difference in purchase price (if the amount of the second trip is greater than the first) or HG Adventure Co will refund any difference in price (if the cost of the second trip is less). All other Terms and Conditions will remain the same with regard to a new trip reservation.

In very unusual situations, HG Adventure Co may be forced to cancel a trip after the departure date for reasons beyond the company’s control as detailed in the Terms & Conditions. In such situations, there can unfortunately be no refunds or compensation of any amount.

CANCELLATION & REFUND POLICY

The following time frames govern HG Adventure Co’s obligation to refund any payments made by guests:

  • Sixty or more days prior to departure: 100% of payment refunded

  • Between 30-59 days prior to departure: 50% of payment refunded

  • Less than 30 days prior to departure: Balance of payments refunded only if HG Adventure Co is able to re-sell your booking to another client.

If you cancel your booking less than 30-days prior to departure, HG Adventure Co will make every reasonable effort to re-sell your booking. However, HG Adventure Co is under no obligation to take any extraordinary measures to try to fill your spot on the trip, so be advised that you may not receive a refund.

TRAVEL INSURANCE

Adequate Travel Insurance is highly recommended for all trips. Be sure your policy covers you for the types of activities you will be on, as well as medical evacuation and repatriation. HG Adventure Co has the right to refuse your Travel Insurance, given the remote nature of our trips, if not deemed suitable. Your reservation for a trip with HG Adventure Co does not include trip insurance of any type. All types of insurance are your responsibility, and you are encouraged to obtain appropriate insurance for your personal belongings, trip cancellation by you due to an illness, injury or family bereavement, trip interruption, medical and legal expenses, and personal liability as you deem necessary. You should consult with a travel insurance professional prior to departure for the best type of insurance for your needs. Although the company will take all steps to help you if you get into a difficult situation, HG Adventure Co cannot be held responsible for your failure to secure appropriate insurance. Medical evacuation and repatriation insurance as part of your travel insurance is highly recommended in the unlikely event you are hurt or evacuated on the trip. All luggage and personal effects are at all times your own responsibility. HG Adventure Co will not be responsible for any loss, delay or costs connected with adverse weather conditions, civil unrest. When you utilize other transportation, not under the direction or control of HG Adventure Co, the terms and conditions of carriage of that carrier shall apply, some of which will limit or exclude liability. Some conditions of carriage are governed by international agreements between countries.

ARRANGED TRANSPORTATION

If you should miss transportation arranged by HG Adventure Co, thereby resulting in your inability to further participate in the trip, the company will not be responsible to refund any amounts to you or for additional costs incurred by you.

MEDIA RELEASE

You grant to HG Adventure Co, its representatives and employees the right to take photographs and images of you and your property in connection with HG Adventure Co’s adventure vacations. You authorize HG Adventure Co, its assignments and transferees to copyright, use and publish the same in print or virtual promotions, advertisements, and other marketing materials. You agree that HG Adventure Co may use such photographs and images of yourself without your name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content. Not every trip will have images or video available for purchase.

ASSUMPTION OF RISK

The activities you will be engaged in do often require a reasonable level of physical fitness and agility. HG Adventure Co reserves the right to reject your booking if your physical condition poses a potential threat to the safety of yourself or other participants or if HG Adventure Co deems it does not have the resources needed to accommodate your physical condition. If HG Adventure Co does proceed with a booking, there may be an additional charge for services or resources needed to accommodate your physical condition. If you are unsure of your ability to participate, you should contact HG Adventure Co and/or speak with a physician prior to booking a trip. If you have already booked a trip and are subsequently unable to participate because of your physical condition, any change or cancellation to your trip is subject to the provisions otherwise detailed in these Terms and Conditions. Your failure to clear your ability to participate in the trip with HG Adventure Co, as detailed herein, and the company’s subsequent determination that your condition poses a significant safety risk, shall not constitute a “substantial change” as defined in the Terms & Conditions. If you require medications, you should ensure you take enough with you to last the trip. Any medication you take with you is your responsibility. All participants will be required to sign a waiver prior to their participation on the trip.

RELEASE OF LIABILITY

HG Adventure Co takes every precaution to ensure the safety of all participants. However, by undertaking a trip with HG Adventure Co, you are assuming the risk of any injury, including death. To help in minimizing the risks to all involved, you are required to follow all instructions of HG Adventure Co employees, suppliers and agents. Failure to follow any instructions or recommendations is at your own risk. HG Adventure Co, its employees and agents cannot be held responsible for any injury caused to you, or by you to others, resulting from your failure to follow any instruction(s) or recommendation(s). If your failure to follow any instruction(s) or recommendation(s) causes an increase in risk, or threatens the safety and enjoyment of others on the trip, HG Adventure Co reserves the right to take all reasonable steps to ensure the safety of the other participants, up to and including, immediate termination of your participation in the trip.

LEGAL DISCLAIMER

By making the reservation for a trip with HG Adventure Co, you agree to be bound by these Terms and Conditions. These Terms and Conditions and any contract to which they apply are governed in all respects by the laws of the United States of America, State of Colorado, and the courts of Douglas County, Colorado. If any part of these Terms and Conditions is determined by a court to be unenforceable, the remainder of the Terms and Conditions shall be unaffected and shall continue in full force and effect.

PRIVACY POLICY

Please read the following to understand how HG Adventure Co uses and protects the personal information you provide, or it receives and collects when you use its services, including how the company collects it, and what the company does with it, as well as some of the steps the company takes to safeguard your personal information. This Privacy Policy may be updated from time to time to keep it up to date with legal requirements and current business operations. You are responsible for reviewing the policy before every trip to inform yourself of any changes.

WHO WE ARE

Hitchhikers Guide Adventure Company is a single-member LLC owned and operated by lead guide Keriann Filippi. For the purposes of this Privacy Policy, references to ‘I’, ‘my’, ‘me’, we’, ‘our’, ‘us’, and ‘HG Adventure Co’ means ‘Hitchhikers Guide Adventure Company’. For the purposes of relevant data protection laws (including each of the EU and UK General Data Protection Regulation (EU/UK GDPR) as well as the California Consumer Privacy Act (2018) (CCPA), HG Adventure Co with whom you contract will be the primary controller of your personal data. This is HG Adventure Co’s principal external facing privacy notice, and it applies to all persons whose personal information is processed by HG Adventure Co (save for HG Adventure Co employees).  As well as applying to our interactions with all of our customers, suppliers and business partners, this Privacy Policy also applies to all information collected over this website www.hgadventureco.com and all other websites, platforms and mobile apps operated by HG Adventure Co and any other online platforms (such as our partners’ websites and social media where we offer online travel-related services).

WHAT INFORMATION WE COLLECT

MAKING AN INQUIRY OR BOOKING A TRIP

We will collect certain information from you when you make an inquiry or book a trip with us. Depending on your interaction with us and what products and services you use, typically we collect the following personal information:

  • your full name, date of birth, gender (i.e. male/female/other), title, postal address, phone number, email address, next of kin, dietary requirements, travel insurance details, passport details (including nationality and city of birth), passport scan, visa application, visa page scan;

  • we may also ask for medical/health information, such as height and weight, pre-existing medical conditions, vaccination status, if you have a disability, medication that requires refrigeration, food allergies etc., some of which is considered sensitive information or special category data under relevant data protection laws; and

  • any additional information you provide during the booking process to check if a trip is right for you, which may include personal information.

We also process and store records of the products and services you have inquired about or purchased from us, as well as collect and process information relevant to your booking (such as flights and accommodation details) that you have not booked through HG Adventure Co, where this information has been passed to us by our partners and/or third parties. We may also receive information about you from other sources. These include business partners, such as our affiliate partners, travel providers and tour operators, travel agents and other independent third parties. Anything we receive from these sources may be combined with information provided by you.

FINANCIAL INFORMATION

We integrate with third party service providers and payment gateways such as to facilitate payments between you and us and our partners and tour operators and agents, as applicable. These service providers share payment information so we can administer and handle your travel services reservation or tour. We are not responsible for the privacy practices of third party vendors and providers, including payment providers, so you should review any privacy policy of third party vendor or providers to satisfy yourself as to how they protect and handle your personal information. In the majority of cases, to make a payment via credit card for your tour/travel services, you will use the secure online booking engine on the relevant website or platform that you are using. In some limited cases you may provide us with your credit card details over the phone. We ask that you do not email or send in writing your payment card details to us or any of our partners at any time.

PHOTO & VIDEO

When you are traveling with us on a tour or branded trip, as part of your experience a photo or video may be taken either by the HG Adventure Co group leader, an employee of HG Adventure Co or one of our partners or another passenger. We care about your privacy so if you do not wish for your photograph to be taken at any time, or to be included in any video, please let your tour group leader or the photographer know. Any photos taken by HG Adventure Co staff (including employees and group leaders) will not be used for marketing purposes without your prior knowledge. While we take every precaution to protect your privacy, we are not responsible for passengers who may take your photograph or video you without our knowledge.

FEEDBACK

We may contact you to seek your interest in taking part in research reviews, surveys, feedbacks, and interviews. Where you have provided the relevant details, we may also contact you in response to your feedback to discuss your comments.

WHY WE COLLECT INFORMATION

We collect, hold and handle your personal information for a variety of business purposes (further information on each of which is set out below), including to:

  • provide you with our and our partner travel products and services, administer your reservations and tours, manage your booking account settings, and generally administer and manage our customer relationship with you;

  • if you are a business partner, supplier or agent, to manage our business relationship with you;

  • contact you and process your communications with us;

  • generally improve our products and services and your user experience with us;

  • comply with our legal obligations and assist government and law enforcement agencies or regulators; and

  • carry out our marketing activities, including identify and share about other travel related products or services that we think may be of interest to you, process feedback forms and other similar communications.

Under applicable privacy and data protection laws (including EU/UK GDPR and the CCPA), for HG Adventure Co to collect, hold, use, share and process your information we must have a purpose and legal basis to do so. The legal basis may differ depending on your interaction with us and what information we collect and process, which will fall under:

  • Necessary for the performance of a contract – When you make an inquiry or book a trip with us or any of our partners, we rely on the legal basis that the processing of your personal information is necessary for the performance of your contract with us.

  • Legitimate Interest – Our legitimate interest means your information has a commercial business purpose and is necessary in order to provide a product or service to you and does not override your rights and freedoms as an individual. When using personal data to serve our or a third party’s legitimate interest, we will always balance your rights and interests in the protection of your personal information against our rights and interests or those of the third party, including by using your information in a way which is proportionate and respects your privacy.

  • Legal Obligations – In certain circumstances we will need to use your information to comply with our legal obligations.

  • Vital Interest – We rely on  the legal basis of vital interest in certain limited circumstances where it is essential to you and your health that we process your personal information.

  • Consent – Where required by applicable laws, we will obtain your prior consent prior to processing your personal information, including before sending you electronic marketing materials or as otherwise required by law.

Providing your personal data to us is voluntary. However, we may not be able to fulfill your reservation and your experience may be affected if certain personal information is not provided. We may only be able to provide you with some products and services if we can only collect some personal data.

MAKING AN INQUIRY OR BOOKING A TRIP

We use your personal information to arrange and provide you with the products and services you have requested and booked. This includes booking any transportation, accommodation and activities:

  • Your personal information will be used by our group leaders to identify you and ensure your safety during the trip.

  • Depending on your destination and services being booked for you, we may be required by the supplier to provide certain types of personal information in order to secure the booking. We may also be legally required by local laws and governments to provide travel documentation such as passport details or a passport scan.

  • Your contact details will be collected in order to manage our relationship with you, including updates about your booking, providing relevant information and any applicable tickets, handling feedback and complaints, and to contact you in the event of an emergency.

  • Providing relevant information, which may include sensitive information, to insurance providers, their agents and medical staff in circumstances where we/they need to act on your behalf or in the interest of passengers or in an emergency.

  • Where permitted by law, where it is in your vital interest or you provide your consent to do so, your medical/health information may be shared to ensure that we understand any specific needs you may have, before and during your trip. Any pre-existing medical conditions could impact your enjoyment of the trip, and by informing us of any conditions, issues or limitations, we can ensure that HG Adventure Co is better prepared to assist if required.

Other than where it is in your vital interests or required by relevant laws, medical/health information can only be used by HG Adventure Co with your consent. This is because medical/health information is considered sensitive and by consenting, you are showing us that you understand and agree with us processing this information. Providing medical/health information and consenting to its use by HG Adventure Co is optional, however, it is highly recommended that information be provided (including if requested) for your safety and well-being.

PHOTO & VIDEO

MARKETING AND OTHER INTERACTIONS

HG Adventure Co may use your information for marketing purposes including:

  • to identify and tell you about HG Adventure Co products and services we think you may be interested in

  • to offer you deals on partner products and services

  • to tell you about trip deals, discounts and promotions; and

  • to administer promotions, feedback surveys and the like.

These products and services may be offered by us, our associated companies, or our brand partners. We will only engage in direct marketing in accordance with the laws of the relevant country or jurisdiction you are located in. To protect privacy rights and to ensure you have control over how we manage marketing with you, we will take steps to limit direct marketing to a reasonable and proportionate level and only send you communications which we believe may be of interest or relevance to you based on the products and services which you have purchased or have registered your interest in purchasing to date. Where you receive electronic marketing communications from us, you may opt out of receiving further marketing communications by following the opt-out instructions provided in the communication.

RESEARCH

We conduct research and analyze your information, including feedback and comments, to help us improve our products and services and to enhance your customer experience, including customizing online content, and to improve your booking and website experience.  We may use your de-identified data for internal reporting, creating new marketing strategies and to identify trends. We may contact you to seek your interest in taking part in research projects, surveys and interviews. Your information and details from our research activities may be stored or kept on file for future reference if relevant and will be de-identified where possible.

HOW WE COLLECT INFORMATION

Your information may come to us in a variety of different ways. You may provide information directly to us or our sales agents, travel agents, business partners, including tour operators and guides, and other third parties (including insurance and medical providers) when communicating via email, phone, letter, web chat or in person. You may also provide us with your information by filling in an online or printed form, leaving feedback, completing a survey or by subscribing to a newsletter or a loyalty program. Your information may also be provided to us by a friend/family member who is booking on your behalf.

MAKING AN INQUIRY OR BOOKING A TRIP

In order to handle your inquiry, fulfill your product or service request or manage your booking, we may share your personal information with the following:

  • any member of HG Adventure Co and our internal contractors and staff, including local group leaders;

  • our network and branded partners;

  • travel providers;

  • other third-party operators;

  • other suppliers and service providers; and

  • in some cases, Government authorities.

We also share your personal information with any travel providers or third-party local operators for the purpose of improving services and experiences, and to investigate complaints and/or disputes, where necessary. You should familiarize yourself with the privacy policies of all travel providers and tour operators you select to provide a trip or travel-related services. We are not responsible for the privacy practices of third-party travel providers and tour operators with whom you may choose to book travel products and services.

SUPPORT SERVICES

We share your personal information with third parties that help us operate, provide, improve, integrate, customize, support and market our products and services.  This includes the following:

  • IT Service Providers: We work with third-party service providers to provide website and application development, hosting, maintenance, backup, storage, virtual infrastructure, support and troubleshooting for quality assurance purposes, payment processing, analysis and other services for us, which may require them to access or use information about you.

We seek to ensure that your information is protected at all times including that these third parties have agreed confidentiality restrictions and only use any personal information we share with them or which they collect on our behalf solely for the purpose of providing the contracted service to us.

OTHER SHARING

We may share or transfer information in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on the services if a transaction takes place, as well as any choices you may have regarding your information. We may share your information with relevant regulators, which may include privacy regulators and supervisory authorities in other jurisdictions, and with courts and law enforcement to comply with all applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies. We also share personal information with insurance providers and/or medical personnel, which may be for identification of fraud or error, for regulatory reporting and compliance, or if we believe the disclosure is necessary to lessen or prevent a threat to life, health or safety. We may share in aggregate, statistical form, non-personal information regarding the visitors to our website, traffic patterns, and website usage with our advertisers.

SELLING DATA

We do not and will not sell your personal information under any circumstances.

CROSS-BORDER TRANSFERS

When we transfer your information overseas, we seek to ensure appropriate privacy, confidentiality and security measures are in place, and that we comply with all applicable data protection and privacy laws. In some jurisdictions, including the EEA, the UK and Australia, data protection laws restrict transferring personal information outside the jurisdiction. We take appropriate steps to ensure that your personal information receives an adequate level of protection (by putting in place appropriate safeguards, such as contractual clauses), or that we are able to rely on an appropriate derogation under applicable privacy and data protection laws.  You have a right to request access to any safeguard which we use to transfer your personal information outside of the UK and the EEA. Where we receive requests for information from law enforcement or regulators, we carefully validate these requests before any personal information is disclosed. You have a right to  contact us at keriann@hgadventureco.com for more information about the safeguards we have put in place.

WHAT YOUR RIGHTS ARE

You have control of the information you provide to us. Subject to certain exemptions, and depending on relevant data protection laws, including in some cases upon our legal basis for processing your information there are certain rights you have over your personal information. These include:

  • You can ask us to update any inaccurate, incomplete or out-of-date information we hold about you

  • You can ask us to provide you with a copy of the information we hold on you, or that we transfer that information to another service provider

  • You may request that we stop processing or using your information

  • You may request that we delete any / all information we hold about you

  • You may withdraw consent that you have provided to us

Where possible we will comply with your request, however, there may be instances where we cannot fulfill your request, or there will be consequences if we were to fulfill your request. We will always communicate with you about any consequences before going forward, or give you written reasons for any refusal. Under certain data protection laws, including the EU/UK GDPR, as well as the CCPA, you may also (subject to certain exceptions):

  • withdraw consent to our use of your information for marketing purposes;

  • object to the processing of your personal data, where we collect your personal data for our legitimate interest;

  • request your personal information be transferred to yourself or a third party without hindrance in a commonly used format.

We may ask you for additional information to confirm your identity and for security purposes, before disclosing the personal information requested to you. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive. We will only perform the activities outlined above to the extent that such activities will not compromise privacy, security or any other legal interests. You may also wish to make a complaint about the way we have handled your personal information or other interference with your privacy rights. You can exercise any of these rights at any time by contacting us (see the Contact Us section) or your relevant privacy or data protection authority.

COMPLAINT TO THE DATA PROTECTION AUTHORITY

If you have any concerns or complaints about how we are collecting or processing your personal information, you can complain to your local data protection authority. We would ask that you first contact us to seek to resolve the concern or complaint in the first instance.

RETENTION

We retain and store most information about you in computer systems and databases operated by either us or our external service providers. Some information about you may be recorded in paper files that we store securely. We will only retain your personal information for as long as necessary to fulfill the purposes we collected it for. In some circumstances we may store your personal information for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax or accounting requirements. In specific circumstances we may store your personal information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your personal information or dealings.

HG Adventure Co is dedicated to keeping your personal information secure. We have implemented various physical, electronic and managerial security procedures in order to protect your information and reduce the risk of loss and misuse, and from unauthorized access, modification, disclosure and interference. We have put in place adequate procedures to deal with any actual or suspected personal information breach and will notify you and any applicable regulator of any data breach where we are legally required to do so. While we take all reasonable steps to ensure that your personal information is secure, we would ask you to be aware that the internet is inherently insecure, so please take precautions when disclosing any personal information online to us.

Our website may include links to third party websites. Clicking on those links may allow third parties to collect or share data about you.
